**This website and online marketplace (“Platform”) is owned and operated by LIMITLESS COMPANY EOOD, a private company registered in Bulgaria under UIC 207395121 (“the Company”, “we”, “our”, “us”). By accessing or using this website, purchasing products, or creating an account, you agree to the following Terms of Service. If you do not agree, please refrain from using the Platform._

*All bottles sold by Apostaxi™ are legally treated as sealed collectible assets and not as alcoholic beverages for consumption. They are sold for collection, display, investment, or asset preservation. Any decision to open or consume a product lies solely with the buyer, and does not change the legal nature of the transaction.*

 

1. Business Model and Nature of Products

 

1.1. The Company sells rare, collectible and investment-grade alcoholic bottles, primarily whisky, obtained from verified private auctions and legally compliant sources within the European Union.


1.2. All products are offered solely in unopened, sealed condition, as collectible assets. They may be considered historical items, discontinued editions, limited releases, or high-value investment goods.


1.3. Although products are sealed, we do not guarantee taste quality, flavour stability, closure integrity (including cork), label condition, or suitability for consumption, especially for older bottles.

1.4. Any decision to open or consume the product is strictly the buyer’s responsibility. The Company accepts no liability for the effects of consumption, including health, taste, or product quality.

All bottles sold through the Platform originate from legally verified sources within the European Union, and where applicable, excise duties (including EU alcohol excise taxes) have been paid at the time of acquisition.

 

2. Age Restriction

 

2.1. By using the Platform and purchasing products, you confirm that you are at least 18 years old, or older where required by local law.


2.2. We reserve the right to:

 

  • request ID verification before shipping;

  • cancel and refund any order placed by a minor or where age verification is refused.

 

3. Pricing, Taxes and Availability

 

3.1. Prices are shown in EUR (€) and may include or exclude tax depending on buyer location and applicable EU regulations.


3.2. Prices of collectible items may vary over time due to market fluctuations, scarcity, or auction value. Price changes do not entitle buyers to refunds or adjustments after purchase.


3.3. Availability is subject to stock. Once sold, products may not be restocked.

 

4. Order Processing and Right to Refuse Sale

 

4.1. We may refuse or cancel orders at any time due to:

 

  • suspected fraud or illegal activity,

  • payment irregularities,

  • age verification failure,

  • legal restrictions in the destination country.

 

4.2. If your order is cancelled before shipping, you will receive a refund of the original payment method minus any processing fees charged by external payment providers.

 

5. Shipping and Transfer of Risk

 

5.1. We ship within the European Union only.


5.2. Shipment includes packaging suitable for fragile and high-value items, but risk of damage, leakage, or breakage transfers to the buyer once the package is handed to the carrier.


5.3. The buyer may purchase optional shipping insurance, offered at checkout.

📌 If the buyer declines insurance, the Company is not liable for loss or damage during transport.


5.4. Shipping times are estimates and may vary. Delays do not entitle refunds or cancellations.

 

6. Returns, Refunds and Product Claims

 

6.1. Due to the nature of collectible and sealed alcoholic goods, all sales are final. We do not accept returns, exchanges, or cancellations after shipment.


6.2. Complaints related to cork condition, internal evaporation (“angel’s share”), label aging, packaging wear, or aesthetic imperfections do not qualify for refund, as these conditions are inherent to collectible bottles.


6.3. If a wrong item is delivered, we will replace it or refund it after return in its original sealed condition.

 

7. Authenticity Guarantee

 


7.1. All products are sourced from legitimate EU auctions and verified suppliers. The Company guarantees:

 

  • original sealed bottles,

  • authentic labels and brand markings,

  • legal acquisition.

 

7.2. The Company does not guarantee future resale value, market appreciation or investment performance.

 

8. Liability Limitation

 

8.1. The Company shall not be liable for:

 

  • consumption effects or health damages,

  • loss of market value,

  • customs seizures or local legal restrictions,

  • shipping damage where insurance was declined.

 

8.2. Our liability shall never exceed the purchase price paid by the buyer.

 

9. Intellectual Property

 

All trademarks, bottle images, logos, descriptions and product names belong to their respective owners. We use them solely for product identification.

 

10. Governing Law

 

These Terms are governed by the laws of Bulgaria and applicable EU regulations. Any disputes shall be resolved exclusively under Bulgarian jurisdiction.
